Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Revenue Receptionist services operated by Revenue Receptionist, LLC ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Revenue Receptionist's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not access or use our services.
2. Description of Services
Revenue Receptionist provides AI-powered communication and scheduling services, including:
- Automated phone answering with AI voice technology
- Real-time appointment scheduling and calendar management
- SMS and text message communications
- Integration with third-party calendars (Google Calendar, etc.)
- Call recording, transcription, and analytics
- Lead capture and follow-up automation
- Dashboard and reporting tools
We reserve the right to modify, suspend, or discontinue any aspect of the services at any time with reasonable notice.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our services. By using our services, you represent that you meet these requirements and that all information you provide is accurate, current, and complete. Our services are intended for business use only.
4. Account Registration & Security
To access our services, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
5. Subscription Plans & Fees
Pricing: Our services are offered on a subscription basis. Current pricing is displayed on our website. All prices are in U.S. dollars unless otherwise stated.
Billing Cycle: Subscriptions are billed monthly or annually in advance, depending on your selected plan. Your subscription will automatically renew at the end of each billing cycle unless cancelled.
Setup Fees: A one-time setup fee may apply to new accounts. This fee covers initial AI training and configuration.
Usage Limits: Plans include specified limits on call minutes, SMS messages, and appointments. Usage beyond included limits will be billed at overage rates specified in your plan.
Price Changes: We may modify pricing with at least 30 days' notice. Continued use after price changes constitutes acceptance.
6. Payment Terms
Payment Methods: We accept major credit cards and ACH transfers. All payments are processed securely through Stripe.
Authorization: By providing payment information, you authorize us to charge your payment method for all fees incurred.
Failed Payments: If a payment fails, we will attempt to process it again. After multiple failed attempts, your account may be suspended. You are responsible for any fees associated with failed payments.
Taxes: You are responsible for all applicable taxes. Prices displayed do not include taxes unless stated.
7. Free Trials
We may offer free trials at our discretion. Free trials provide access to services for a limited period. At the end of the trial period, you will be automatically enrolled in a paid subscription unless you cancel before the trial ends. We reserve the right to limit trial eligibility and features available during trials.
8. Cancellation & Refunds
Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support@revenuereceptionist.com. Cancellation takes effect at the end of your current billing period. You will retain access to services until that date.
Refunds: Subscription fees are generally non-refundable. However, if you are dissatisfied with our services within the first 14 days of your initial subscription, you may request a full refund. Refund requests must be submitted to billing@revenuereceptionist.com.
No Partial Refunds: We do not provide refunds for partial months or unused portions of annual subscriptions, except as required by law.
9. Acceptable Use Policy
You agree to use our services only for lawful purposes and in accordance with these Terms. You shall NOT:
- Use services for any illegal, fraudulent, or unauthorized purpose
- Transmit spam, unsolicited bulk messaging, or marketing without consent
- Engage in robocalling in violation of applicable law
- Use deceptive caller identification or impersonate any person or entity
- Conduct political spam or unlawful campaign outreach
- Harass, threaten, or abuse others through our services
- Initiate communications without legally required recipient consent
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Reverse engineer, decompile, or disassemble any part of our services
- Use our services to transmit malware, viruses, or harmful code
- Violate any applicable laws, regulations, or third-party rights
Violation of this policy may result in immediate suspension or termination without refund. To report abuse or suspicious communications, contact abuse@revenuereceptionist.com.
9A. Telecommunications Compliance & TCPA Consent
You represent and warrant that you have obtained all necessary rights, permissions, and consents required to contact individuals using Revenue Receptionist services, including consent required under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, applicable state call recording laws, and similar federal and state telecommunications regulations.
You agree not to use the platform for unsolicited marketing, unlawful automated calling, or prohibited messaging activities.
Your Responsibilities Include:
- Maintaining records of recipient consent for all outbound communications
- Honoring opt-out and STOP requests promptly and permanently
- Providing required caller identification and disclosure information
- Complying with applicable do-not-call registries and lists
- Providing legally required notices regarding AI or automated systems where applicable
Revenue Receptionist reserves the right to suspend or terminate accounts that generate abuse complaints, violate telecommunications regulations, or otherwise misuse the platform's calling and messaging capabilities. You agree to indemnify Revenue Receptionist against any claims, fines, or penalties arising from your failure to comply with applicable telecommunications laws.
10. Your Data & Content
Ownership: You retain all rights to your data, including business information, customer data, call recordings, and content you provide ("Your Data"). We claim no ownership over Your Data.
License Grant: You grant us a limited, non-exclusive, worldwide license to use, process, and store Your Data solely to provide and improve our services. This license terminates when you delete your account.
Responsibility: You are solely responsible for the accuracy, quality, and legality of Your Data and the means by which you acquired it. You represent that you have all necessary rights and consents to provide Your Data to us.
Data Export: You may export Your Data at any time through our dashboard. Upon account termination, we will retain Your Data for 30 days to allow retrieval, after which it will be deleted.
11. Intellectual Property
Our IP: All content, software, technology, trademarks, and materials comprising our services are owned by or licensed to Revenue Receptionist and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on our services without explicit permission.
Feedback: Any feedback, suggestions, or ideas you provide about our services may be used by us without obligation or compensation to you.
12. Third-Party Integrations
Our services integrate with third-party applications (Google Calendar, CRMs, etc.). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services. Integration with third-party services may require you to grant us access to your accounts on those services.
13. Service Availability & SLA
Uptime Target: We strive to maintain 99.9% service availability, excluding scheduled maintenance and circumstances beyond our control.
Maintenance: We may perform scheduled maintenance with advance notice when possible. Emergency maintenance may occur without notice.
No Guarantee: While we strive for high availability, we do not guarantee uninterrupted or error-free service. You acknowledge that temporary service interruptions may occur.
14. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THAT OUR AI WILL PROVIDE PERFECT RESPONSES IN ALL SITUATIONS. YOU USE OUR SERVICES AT YOUR OWN RISK.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVENUE RECEPTIONIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Actions or content of third parties
- Any matter beyond our reasonable control
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless Revenue Receptionist and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) Your Data; or (e) your negligence or willful misconduct.
17. Termination
By You: You may terminate your account at any time by cancelling your subscription and ceasing use of our services.
By Us: We may suspend or terminate your account immediately without notice if you: violate these Terms, engage in fraudulent activity, fail to pay fees, or if required by law. We may also terminate for convenience with 30 days' notice.
Effect of Termination: Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
18. Dispute Resolution
Informal Resolution: Before filing any claim, you agree to contact us at legal@revenuereceptionist.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. Arbitration shall take place in Los Angeles, California. Each party shall bear its own costs.
Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
20. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and/or sending you an email at least 30 days before the changes take effect. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using our services and cancel your account.
21. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Revenue Receptionist regarding our services and supersede all prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
